1. QImaging warrants to the original purchaser that, from the date of delivery, any Products sold to you under this Agreement will conform to our then-current published specifications and will be free from defects in materials and workmanship under normal use and service. This warranty is limited to a period of 24 months from the shipment date from QImaging, excepting the mechanical shutter in the PMI-Series cameras, which is warranted for 90 days. Our sole obligation to you and your exclusive remedy under this warranty is as follows:

(a) During the warranty period, we will repair or replace without charge any component of the Product which is found to be defective if you return it to us, freight prepaid to the service center we designate and will provide the labour to replace the component at no charge to you or your customer. At our option, however we may instead elect either to repair the Product at your facility or your customer’s site or else accept return of the Product and refund to you the purchase price you paid for it.

(b) We will not be required to ship a replacement component to you until we have confirmed through our examination that your item is in fact defective, but our decision is subject to good-faith negotiation or verification by a third-party examination. We will pay freight costs to ship any repaired or replacement unit to you and you will pay all freight costs to ship the item to us.

(c) This warranty does not apply to any unit which we determine has been subjected by you or another party to

i. operating or environmental conditions in excess of our written specifications or recommendations; or

ii. accident, damage, misuse or neglect; or

iii. improper installation, repair or alteration.
